Historical background of the legal literature and case law discussion on the admission of pain and suffering

This case law commentary aims to highlight some historical precedents of positive law that have been fundamental in the acceptance of pain and suffering in Uruguayan civil law at legal literature and case law levels, such as section 1345 of the Civil Code that was used in the legal literature discussions of the first half of the 20th Century, whose argumentative value may not be ignored.
