Abstract

This paper analyses hardship as a cause of agreement termination, seeking to go beyond the agreement’s handling, relating it to the economic operation, and thus contemplate the current legal needs of our system, as a result of global economic fluctuations, highlighting a reflection on the need to include the theory of risk in current regulations.
